Payment & Breeding Terms Guardian Fee: Non-refundable $________. Breeding Obligations: Females: 4–6 litters (health permitting). Males: 5 years of stud services (health permitting). Compensation: Breeder pays Guardian a set amount for each successful litter/stud service. 2. Pet Insurance & Routine Vet Care Pet Insurance: Guardian will maintain pet insurance if required by Breeder. Routine Costs: Guardian covers normal vet expenses (vaccines, parasite prevention, etc.). Breeder covers breeding-related vet costs. 3. Canine Good Citizen & Training Training: Guardian works toward basic obedience and AKC CGC standards, providing ongoing socialization. Breeder Visits: Breeder may do scheduled or surprise visits to ensure dog’s welfare. 4. Transportation Vet & Breeding Appointments: Guardian transports Guardian Dog for inseminations, vet checks, etc. Puppy Delivery: Female puppies go to Breeder at ~7.5 weeks unless otherwise agreed. 5. Communication Heat Cycles (Females): Notify Breeder at the first sign of each heat. Keep dog away from intact males unless for approved breeding. Proximity (Males): Alert Breeder to any in-heat females nearby to prevent unapproved breeding. 6. Ownership & Property Breeder-Owned: Dog remains Breeder’s property until contract terms are fulfilled. Transfer: Upon completion, Breeder spays/neuters at own expense and transfers ownership to Guardian. Offspring/Semen: All puppies (female dogs) or semen (male dogs) belong exclusively to Breeder. 7. Breeder’s Responsibilities Provide a healthy dog and care guidelines. Cover all breeding-related vet costs (testing, insemination, whelping). Take possession of dog for breeding/whelping (females) or stud usage (males). Take dog back if Guardian cannot continue (no refunds). 8. Guardian’s Responsibilities Diet & Vaccinations: Feed high-quality food; keep vaccines current. Training: Provide obedience and socialization (AKC CGC recommended). Supervision: Keep dog safe and controlled, especially during heat cycles (females) or around in-heat females (males). Routine Vet Care: Guardian covers routine check-ups, dental, etc. Grooming: Ensure regular coat maintenance (brushing/grooming every 6–8 weeks). Accidental Breeding: Report within 24 hours or pay $5,000 liquidated damages. Address Changes: Obtain written Breeder approval before moving. Microchip & Lost/Stolen: Keep microchip info updated with both Breeder’s and Guardian’s contact. Immediately notify Breeder if dog is lost or stolen. Third-Party Boarding: Inform Breeder if dog will be left with a caretaker or boarding facility. Extended stays require Breeder approval. 9. Travel or Relocation Restrictions Moving Out of Area: Must have written Breeder consent before relocating out of reasonable distance or out of state. International Travel: Prohibited unless Breeder explicitly approves in writing. 10. Additional Health & Welfare Prohibited Procedures: No cosmetic surgeries (docking, cropping) without Breeder approval. Emergency Care: Guardian may seek urgent vet treatment if dog’s life is at risk; inform Breeder ASAP. 11. Behavioral Expectations & Return Clause No Fighting/Baiting: Dog must never be used for fighting or inhumane activities. Behavior Issues: If severe behavior issues arise and cannot be managed, Guardian may return the dog to Breeder. 12. No Guarantee of Breeding Success Breeder does not guarantee specific litter size or breeding results. Payment to Guardian depends on actual successful litters or stud services. 13. Euthanasia or Major Health Decisions Serious Illness/Injury: Breeder must be consulted before any euthanasia unless delaying would cause undue suffering. Costs: If unrelated to breeding, Guardian usually bears costs; if breeding-related, Breeder covers. 14. Liability & Indemnification Damages/Injury: Guardian assumes liability for any damage or injury caused by the dog while in Guardian’s care. Insurance: Guardian is strongly encouraged (or required) to have homeowner’s/renter’s coverage for dog-related incidents. Hold Harmless: Guardian indemnifies Breeder from all claims arising out of the dog’s actions. 15. Termination Breeder Removal: Breeder may repossess the dog if Guardian violates contract terms or endangers the dog’s health. Death of Dog: If non-negligent, contract ends without further obligation (if female dies whelping, see special clause for possible puppy). Return Option: Guardian may return the dog anytime; contract ends, no refund. 16. Severability & Liquidated Damages $15,000 Penalty: Guardian pays if dog is spayed/neutered without permission, intentionally harmed, or if Guardian absconds with dog. Non-Transferable: This Contract cannot be assigned to another person or breeder without Breeder’s written approval. Severability: Any unenforceable provision does not invalidate the remainder of the Contract. 17. Image Rights Breeder May Use Photos: For promotional/educational use. Guardian Photos: Guardian won’t alter or sell Breeder’s professional images. Guardian’s personal images may be reposted by Breeder with credit. 18. Integration, Governing Law & Jurisdiction Entire Agreement: Supersedes all prior written or oral agreements. Governing Law: Utah law applies. Jurisdiction: Disputes resolved exclusively in Utah courts; jury trial is waived. 19. Enforcement & Amendments Attorneys’ Fees: Prevailing party in enforcement or breach action recovers reasonable attorneys’ fees. Amendments: Must be in writing, signed by Breeder and Guardian. 20. Virtual Signature Binding Acknowledgement: By signing (physically or electronically), all parties acknowledge this is a legally binding Contract. I understand and agree to these terms Purpose of Contract * Breeder is a “Doodle” breeder who maintains a Guardian Home Program. The program allows select breeding dogs—whether they are puppies or adult dogs at the time of placement (“Guardian Dog”)—to be placed with loving, permanent Guardian Homes, while the Breeder retains breeding rights for a predetermined period or number of litters/stud services. The Guardian wishes to (1) provide a loving, forever home to the Guardian Dog and (2) support the Breeder’s breeding program in accordance with the terms of this Contract.
